Right of Appeal

If you wish to have your case tried before a jury, you must notify the Judge prior to entering a plea. A filing fee must be paid and an application for jury trial must be submitted to the Court Clerk at window in the lobby. This form and filing fee is required by the St. Charles County Circuit Court in order to transfer the case.

If the Judge finds you guilty during trial, you have the right to appeal the decision. When you appeal, you are asking for a new trial. The new trial is called a Trial De Novo. Your Application for Trial De Novo must be filed within 10 days of the first trial. Payment of any portion of the fine or failure to file within 10 days forfeits your right to appeal.

A filing fee and notarized application for Trial De Novo must be filed with the Court Clerk at the window in the lobby before transferring the case to the St. Charles County Circuit Court .The fee payment must be in the form of a money order only in the amount of $30 payable to the order of the St. Charles County Circuit Court.
